TAKT 5-Year Commercial Guarantee Terms

Effective from: October 1st, 2026

TAKT offers a 5-year commercial guarantee on eligible TAKT furniture products. This commercial guarantee is provided in addition to, and does not replace or limit, the consumer’s statutory rights under applicable law.

1. Scope of the Guarantee
The TAKT 5-year commercial guarantee applies to eligible TAKT furniture products purchased from TAKT or an authorised TAKT retailer.

The guarantee applies for a period of 5 years from the date of delivery of the product to the original purchaser.

The guarantee covers defects in materials, workmanship and manufacturing that prevent the product from maintaining its required functions and performance under normal and intended use during the guarantee period.

Where a covered defect is confirmed, TAKT will, at its discretion and in accordance with applicable law:

  • Repair the defective product or component;
  • Replace the defective product or component; or
  • Where repair or replacement is not reasonably possible, provide an appropriate alternative remedy.

Any repair or replacement under this commercial guarantee will be provided at no cost to the consumer, subject to the terms of this guarantee and applicable mandatory law.

2. What the Guarantee Covers
The guarantee may cover, for example:

  • Defects in the construction or assembly of the product;
  • Manufacturing defects in structural components;
  • Defects in materials that result in premature failure under normal and intended use;
  • Defective fittings, hardware, mechanisms or other components where the defect is attributable to materials, workmanship or manufacturing;
  • Defects in upholstery, foam, textiles, leather or other materials where the issue is attributable to a manufacturing or material defect rather than normal wear or use;
  • Defects in surface treatments, such as lacquer, paint or oil, where the issue is attributable to a manufacturing or application defect; and
  • Other defects attributable to TAKT’s materials, workmanship or manufacturing process.

The fact that a component or surface has deteriorated does not, by itself, mean that the issue is covered by the commercial guarantee. The cause of the deterioration will be relevant when determining whether it constitutes a covered defect or normal wear and tear.

3. Normal Wear and Tear, Wear Parts and Surface Deterioration
The TAKT 5-year commercial guarantee does not cover normal wear and tear or the normal deterioration of parts and surfaces resulting from ordinary use, ageing or the environment in which the product is used.

This includes, but is not limited to:

  • Normal wear of upholstery, textiles, leather and covers caused by use;
  • Gradual changes in colour, appearance or texture resulting from normal use, exposure to light or ageing;
  • Stains, discolouration or other damage caused by spills, including food, beverages or other substances;
  • Scratches, abrasions, dents, marks or other surface damage caused by use, impact or external factors;
  • Gradual wear of lacquer, paint, oil or other surface treatments resulting from normal use;
  • Natural changes in wood, leather and other natural materials associated with ageing and use;
  • Wear of gliders, feet, pads, castors and other replaceable wear parts;
  • Deterioration of components that are intended to be replaced as part of normal maintenance or use; and
  • Other deterioration that is a natural consequence of the intended use and ageing of the product.

Where a part is specifically designed to be replaced as a result of normal wear and tear, replacement of that part due solely to such wear is not covered by the commercial guarantee.

However, this exclusion does not apply where the relevant issue is caused by a defect in materials, workmanship or manufacturing.
For example:

  • A textile becoming worn through normal use is not covered;
  • A textile separating from its construction because of a manufacturing defect may be covered;
  • A glider wearing down through normal use is not covered;
  • A glider becoming detached because of a defective fitting may be covered;
  • Lacquer gradually becoming worn through normal use is not covered;
  • Lacquer peeling or flaking prematurely because of a manufacturing or application defect may be covered.

4. Damage Caused by Use, Accidents or External Factors
The commercial guarantee does not cover damage resulting from circumstances outside TAKT’s manufacturing responsibility, including:

  • Accidents, impact, dropping or overturning;
  • Misuse or use contrary to the product’s intended purpose;
  • Excessive loads or other use outside the stated product specifications;
  • Improper installation or assembly;
  • Incorrect relocation or handling of the product;
  • Exposure to excessive heat, moisture, water, frost, direct sunlight or other environmental conditions beyond those reasonably intended for the product;
  • Stains, spills or contamination;
  • Contact with chemicals, cleaning agents or other substances that are incompatible with the product;
  • Damage caused by pets, sharp objects or other external factors;
  • Modifications or alterations made without TAKT’s approval; and
  • Failure to follow TAKT’s care, maintenance, assembly or installation instructions.

5. Care and Maintenance
The product must be used and maintained in accordance with TAKT’s applicable care and maintenance instructions.

Failure to follow the relevant care and maintenance instructions may result in damage that is not covered by the commercial guarantee.

This does not exclude coverage where the underlying issue is a defect in materials, workmanship or manufacturing.

6. Replacement Components
Where a covered defect concerns a replaceable component, TAKT may choose to replace the affected component rather than the complete product.

Replacement components may differ slightly in colour, texture, grain, finish or appearance from the original component due to natural material variation, ageing, changes in production or discontinued materials.
Such differences do not in themselves constitute a defect.

Where a particular material, component or finish is no longer available, TAKT may provide a suitable alternative of comparable function and quality, subject to applicable law.

7. Products with Natural Materials
TAKT uses natural and naturally variable materials, including wood and leather.

Variations in colour, grain, texture, markings and other characteristics are inherent to such materials and are not considered defects where they fall within the normal characteristics of the material.

Changes that naturally occur through ageing, exposure to light and normal use are likewise not considered defects.
This does not exclude defects caused by faulty materials, workmanship or manufacturing.

8. Upholstery, Foam, Textiles and Leather
Upholstered products are subject to normal changes through use.

Depending on the material and construction, normal use may result in changes such as:

  • Slight changes in the appearance or texture of upholstery;
  • Compression or settling of foam and filling materials;
  • Minor changes in shape or firmness;
  • Changes in textile or leather appearance resulting from use; and
  • Normal wear of covers and upholstery surfaces.

Such changes are not covered by the commercial guarantee where they constitute normal wear and ageing.

However, defects such as premature material failure, defective stitching, faulty seams, manufacturing defects in upholstery construction or other defects attributable to materials or workmanship may be covered.

9. Surface Finishes
TAKT furniture may be supplied with lacquered, painted, oiled or otherwise treated surfaces.

Normal wear, minor scratches, marks, changes in sheen, patina and gradual deterioration of the surface finish resulting from ordinary use are not covered by the commercial guarantee.

However, premature peeling, flaking, cracking, delamination or other failure of a surface treatment may be covered where the issue is attributable to a defect in the material, application or manufacturing process.

10. Glass and Other Fragile Components
Breakage or damage to glass and other fragile components caused by impact, incorrect handling, installation, relocation or other external factors is not covered by the commercial guarantee.

Manufacturing defects or defects in the material that result in failure under normal and intended use may be covered.

11. Electrical or Mechanical Components
Where a TAKT product contains electrical, mechanical or other technical components, the commercial guarantee covers defects in such components where the defect is attributable to materials, workmanship or manufacturing.

Damage caused by incorrect installation, misuse, unauthorised modification, external factors or normal wear is not covered.
Where a component is subject to a separate manufacturer’s commercial guarantee, that guarantee may also apply.

12. Who Can Make a Claim
The commercial guarantee applies to the original purchaser of the product.

If the product is transferred to another person, the commercial guarantee does not automatically transfer unless this is expressly permitted by TAKT or required by applicable law.

Nothing in this section limits any statutory rights that may apply to subsequent owners or users under mandatory law.

13. How to Make a Guarantee Claim
To make a claim under the commercial guarantee, the consumer should contact TAKT Customer Care:

The consumer should provide:

  • Order or proof-of-purchase information;
  • The product name or product identification;
  • A description of the issue;
  • Photographs or other documentation showing the issue, where relevant; and
  • Any other information reasonably required by TAKT to assess the claim.

TAKT may request additional information or arrange an inspection of the product where reasonably necessary to determine the cause of the issue.

Consumers should contact TAKT as soon as reasonably possible after becoming aware of an issue.

14. Assessment of Claims
TAKT will assess whether the reported issue constitutes a defect covered by the commercial guarantee.

The assessment may take into account:

  • The age and condition of the product;
  • The nature of the reported issue;
  • The intended use of the product;
  • The product’s care and maintenance history;
  • Whether the issue is consistent with normal wear and ageing; and
  • Whether the issue is attributable to materials, workmanship or manufacturing.

The fact that an issue occurs during the 5-year guarantee period does not automatically mean that the issue is covered.

15. Remedies
Where TAKT determines that a defect is covered by the commercial guarantee, TAKT will provide an appropriate remedy in accordance with this guarantee and applicable law.

Depending on the circumstances, TAKT may:

  1. Repair the defective product or component;
  2. Replace the defective product or component; or
  3. Provide another appropriate remedy where repair or replacement is not reasonably possible.

TAKT will determine the appropriate remedy taking into account the nature of the defect, availability of components, product condition and applicable law.

Nothing in this section limits any remedy that the consumer may have under the statutory legal guarantee of conformity.

16. Transport and Related Costs
Where a claim is accepted under the commercial guarantee, TAKT will cover reasonable costs directly associated with the agreed repair or replacement, where required by applicable law or expressly included in the commercial guarantee.
TAKT may provide specific instructions concerning transport, collection, return or inspection of the product.
Consumers should not return products without first contacting TAKT and receiving instructions.

17. Statutory Legal Guarantee of Conformity
This commercial guarantee is provided in addition to the consumer’s statutory legal guarantee of conformity.
Consumers have statutory rights in relation to goods that do not conform to the contract. These rights are provided by applicable consumer protection legislation and are not affected by this commercial guarantee.

The commercial guarantee therefore does not limit, replace or reduce any statutory rights or remedies available to the consumer.
Where mandatory national law provides consumers with rights that are more favourable than those described in these commercial guarantee terms, those rights remain unaffected.

The statutory legal guarantee and the TAKT 5-year commercial guarantee are separate legal protections.

18. Relationship with the GARAN Label
Where applicable, TAKT may use the EU harmonised GARAN label to communicate its commercial guarantee of durability.
The GARAN label is associated with a commercial guarantee of durability and does not replace the consumer’s statutory legal guarantee of conformity.

Where the GARAN label is used, the applicable guarantee period and terms will be provided to the consumer in accordance with applicable EU and national requirements.

The EU harmonised GARAN framework applies from 27 September 2026.

19. Advertising and Guarantee Statements
This commercial guarantee is binding on TAKT in accordance with its stated terms and applicable law.
Where TAKT’s advertising or other consumer-facing communication concerning the commercial guarantee provides conditions that are more favourable to the consumer than these terms, the more favourable conditions may apply in accordance with applicable law.

The commercial guarantee statement will be made available to the consumer on a durable medium no later than delivery of the goods, as required by applicable EU law.

20. Territorial Scope
This commercial guarantee is intended to apply to eligible TAKT products sold to consumers within the European Union, subject to applicable national mandatory law.

For sales outside the European Union, including the United Kingdom and Switzerland, separate terms or additional mandatory requirements may apply.

21. Governing Law and Consumer Rights
These commercial guarantee terms are governed by Danish law, without prejudice to any mandatory consumer protection provisions applicable in the country where the consumer has their habitual residence.
Nothing in these terms is intended to exclude or restrict mandatory rights that consumers have under applicable law.

Important notice to consumers
The TAKT 5-year commercial guarantee is an additional guarantee provided by TAKT. It does not affect your statutory legal rights.

If a TAKT product does not conform to the contract, you may have statutory rights to remedies from the seller free of charge under applicable law. These rights exist independently of the TAKT 5-year commercial guarantee.

The commercial guarantee provides additional protection for eligible TAKT products for 5 years from delivery, subject to the terms set out above.
